Terms of Service

These terms set out how Daybreak works, what you're agreeing to when you use the service, and what each of us is responsible for. The four most important points are highlighted first; the full agreement follows below.

Not a substitute for care

Daybreak supports recovery — it doesn't replace a therapist, doctor, or emergency services. In a crisis: 988 (US Suicide & Crisis Lifeline) or 911.

Cancel anytime

No contracts, no minimum term. Cancel mid-cycle and keep paid features until the cycle ends.

7-day refund window

Full refund within 7 days of your first Premium payment. Email [email protected].

18+ only

You must be at least 18 to use the Service. We don't knowingly collect data from minors.

1. Acceptance of terms

By accessing or using Daybreak (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of service

Daybreak is a science-based recovery support platform that provides evidence-based tracking, AI-powered coaching, therapeutic journaling, and personalized recovery plan tools.

3. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this age requirement.

4. Account responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Providing accurate information during registration
  • Notifying us immediately of any unauthorized use of your account

5. Acceptable use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to other users' accounts or data
  • Interfere with or disrupt the Service or its infrastructure
  • Use Dawn (the AI companion) to generate harmful, illegal, or exploitative content
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems (bots, scrapers) to access the Service

6. Subscription & payments

Free tier

The free tier provides limited access to core features and is available indefinitely at no cost.

Premium subscription

Premium subscriptions are billed monthly or annually through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Cancellation

You may cancel your subscription at any time from Settings. Upon cancellation, you will retain Premium access until the end of your current billing period.

Refunds

We offer a full refund within 7 days of your first Premium payment. After this period, payments are non-refundable. Contact [email protected] for refund requests.

7. AI-generated content

Dawn and Recovery Plan features use artificial intelligence. While grounded in evidence-based frameworks:

  • AI-generated content may not always be accurate or appropriate for your situation
  • AI responses do not constitute professional medical or psychological advice
  • You should always consult qualified healthcare professionals for medical decisions
  • We are not liable for actions taken based on AI-generated content

8. Native applications

Our desktop and mobile applications are subject to additional terms:

  • Native Apps require operating system permissions to function. You grant these at your discretion.
  • Screen-time data is stored locally on your device by default. Cloud sync is optional and uses end-to-end encryption.
  • App blocking features are self-management tools and can be overridden by the user.
  • Native Apps distributed through app stores are also subject to those platforms' terms.

9. Intellectual property

The Service is owned by Daybreak and protected by intellectual property laws. You retain ownership of your content (journal entries, check-in data, etc.).

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYBREAK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Privacy

Your use of the Service is also governed by our Privacy Policy.

12. Termination

We may suspend or terminate your account for Terms violations. You may delete your account at any time from Settings.

13. Changes to terms

We may modify these Terms at any time. We will notify you of material changes via email or a notice within the Service.

14. Governing law

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles.
